IDENTIFICATION OF THE PARTIES

1. Website

The website www.tenerifepass.net belongs to TRALOPIA INTERNATIONAL S. L., a company with registered office at Calle El Roque, 22, 38330 – San Cristóbal de La Laguna- S/C de Tenerife (Spain), CIF B-76737840 registered in the Mercantile Registry of Tenerife in volume 3511, folio 100, page number TF-59340 with administrative authorisation granted by the Government of the Canary Islands to carry out the activity of tourist intermediary, with number I-1.0004147.1, (hereinafter “TENERIFE PASS”), through which users of the same, can access various information on leisure, travel and tourism, and for which TENERIFE PASS has the necessary licenses and permits for the activities of a travel agency.

2. User

  • This is the natural person (hereinafter the user) who accesses the page to obtain information and contract the services offered through the website.
  • A user is considered to be the person who contacts by telephone, chat or via email, from the same email address that was entered at the time of purchase.
  • The user declares that they are of legal age and have the necessary legal capacity to acquire the services offered through the “TENERIFE PASS” website.
  • TENERIFE PASS cannot verify the age of the user, so it is not responsible for the veracity and accuracy of the data filled in by the user.
  • The user, both natural and legal persons, declares that they have the legal capacity to acquire the services offered in http://tenerifepass.net.

ACCEPTANCE OF THE TERMS

This document establishes the General Conditions of Use of the services provided through the TENERIFE PASS website, reserving within the limits permitted by Law, the right to modify and update them periodically, without the obligation of prior communication to users.

These terms of use do not exclude the possibility that certain services provided through the website, due to their particular characteristics, may be subject to their own specific conditions of use.

The fact of accessing, browsing and using our website and/or making a purchase, implies having read, understood and accepted the general conditions, which are considered automatically incorporated into the contract, without the need for a written transcription or conventional signature.

It is mandatory for the user to read the General Terms and Conditions carefully and accept them each time they intend to make a purchase through the web portal, given that they may have undergone modifications since the last time they accessed.

If you do not accept these General Terms and Conditions of Use, you will not be able to make purchases on our website.

DESCRIPTION OF SERVICE

Through the TENERIFE PASS website, users are offered access to various information about leisure, travel and tourist services, also making it possible to contract some of the services offered online.

Users may obtain information about the exclusive products of TENERIFE PASS through the website, and in some cases may even proceed to contract them online or by telephone, and in respect of which TENERIFE PASS provides the content and service in its name and on its own behalf.

In addition to these services, the user may formalise purchases and contract online or by telephone accommodation and package trips, as well as other services, provided by TENERIFE PASS, the information relating to these services, although the technical organisation of the same and formalisation of purchases will be carried out by wholesale agencies, and, in general, the providers of the corresponding services, where appropriate, TENERIFE PASS’s liability being limited to the obligations that are legally attributed to it, in its capacity as a retail travel agency.

OBLIGATIONS OF THE USER

The user undertakes to use the services and content on our website in accordance with the Law and the general and particular terms and conditions of the services offered by TENERIFE PASS at all times, and must refrain from using them to:

  • Carrying out illegal activities or activities that constitute a crime, contrary to good faith, morality and public order, to customs, and/or that infringe the regulation on intellectual and industrial property, or any other rule of the applicable legal system.
  • Using the website for purposes that are harmful to TENERIFE PASS or any of the companies of the business group to which it belongs, hereinafter referred to as the TRALOPIA INTERNATIONAL group, or any third party, or that, in any way, may cause damage or prevent the normal functioning of the website.
  • Introducing or disseminating data programs (viruses and harmful software) on the network that may cause damage to the computer systems of the TRALOPIA INTERNATIONAL group, its suppliers or third party users of the Internet network.
  • Making speculative, fraudulent or false requests or contracts.
  • Include website information in price comparison tools.
  • Access the website using a robot, spider or any automatic search tool or program.
  • Carrying out activities that constitute an infringement of the regulation on intellectual and industrial property or any other rule of the applicable legal system.
  • You may not resell, deep-link, use, copy, monitor (e.g., spider, scraper), display, download, or reproduce the content, information, software, products, or services available on our website for any commercial or competitive activity.
  • Use the social networks made available by TENERIFE PASS to insert messages that are not directly related to the theme of leisure or travel, in particular, illegal, illicit, defamatory content or any other content that could infringe the rights of third parties or damage computer systems, reserving the right to remove any message that in its opinion it deems inappropriate.
  • Disseminating content or propaganda of a racist, xenophobic, pornographic nature, advocating terrorism, or that violates human rights.
  • Make available to other users, send by e-mail or otherwise transmit, any content that, in accordance with applicable provisions or existing contractual relationships, You are not authorized to transmit (such as privileged information, information protected by industrial or intellectual property rights or information about which You have a duty of confidentiality).
  • Transmit unsolicited or unauthorized advertising, advertising material, “junk mail,” “chain letters,” “pyramid schemes,” or any other form of solicitation, except in those areas (such as commercial spaces) that are exclusively designed for that purpose.
  • Users are also expressly prohibited from reproducing, duplicating, copying, selling, reselling, or exploiting for commercial purposes, any portion of the service, use, or access thereto.
  • If your usernames and passwords become known to an unauthorised user, you undertake to immediately inform TENERIFE PASS, which reserves the right to modify for the protection of the service. The user undertakes to diligently guard and keep secret the passwords provided by TENERIFE PASS and to assume the consequences or economic damages suffered due to the lack of diligence in the custody of the same.

TENERIFE PASS reserves the right to deny access to the website at any time, without prior notice and without the right to compensation, to those users who fail to comply with these General Conditions, or the particular conditions that may be applicable in each case. If TENERIFE PASS has reasonable grounds to consider that a purchase has been made in contravention of these General Conditions, or the particular conditions that apply to it in each case, it will be authorised to cancel it and may inform the relevant authorities.

The user undertakes and declares that all the data entered for the purchase request is true, especially the e-mail address provided for notifications. The agency makes available, for the verification of the data entered by the user, a summary on each screen and a final summary once the application and/or purchase through our website has been completed. Otherwise, TENERIFE PASS is not responsible for any setback that may arise.

LIMITATIONS OF LIABILITY

Exclusion of liability of TENERIFE PASS:

  • Any liability that may arise from interferences, omissions, interruptions, computer viruses, telephone breakdowns or disconnections in the operational functioning of the electronic system, caused by causes beyond the control of TENERIFE PASS.
  • Damages suffered by the user as a result of informing him/herself or his/her principal, erroneously his/her email address and/or telephone number.
  • The links and hypertext that make it possible through the website to access features and services offered by third parties do not belong to or are under the control of TENERIFE PASS, and it is not responsible for the correct functioning of such links, as well as the information contained therein or for any effects that may arise from said information. nor of the prejudices that the user may suffer by virtue of the information found on the linked website.
  • Damage that may be caused to users’ computers by using the portal.

Certain information included on the TENERIFE PASS website or provided by telephone has been provided by the providers of the services offered on the website. TENERIFE PASS is not responsible for the veracity of the contents or for any errors that may arise from such information.

Within the website there may be links to other websites for which TENERIFE PASS has no control and for whose content it is not responsible. Similarly, TENERIFE PASS will not be responsible for the technical availability of the web pages that the user accesses through its website.

The user assumes sole responsibility for any damages or losses that, where appropriate, may arise from access to said content, as well as for any other damage or harm caused to their computer system by any material downloaded or in any way obtained through the use of the services or by any loss of data derived from downloading said material.

Likewise, TENERIFE PASS will not be liable for damages arising from infringements by any user that affect the rights of another user, or of third parties, including copyrights, trademarks, patents, confidential information and any other intellectual and industrial property rights.

TENERIFE PASS will not be liable for any damages caused to the user in the event of impossibility of providing the services subject to these general conditions of use, in cases of force majeure, fortuitous event or other causes not attributable to the user. Nor will TENERIFE PASS be responsible for the improper use of the service as a result of maintenance work, or a defective configuration of the user’s computer equipment, or the insufficient capacity to support the computer systems necessary for the use of the services offered.

APPLICABLE LEGISLATION

These general conditions of use, as well as the relationship between TENERIFE PASS and the user with respect to them, will be governed by Spanish law.

Anything not contained in these general conditions will be subject to the contents of Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defence of Consumers and Users and other complementary laws or that which replaces it.

The Courts of the consumer’s domicile will be competent to hear any dispute arising from these conditions.

CONDITIONS OF SALE

1. Web Selling

TENERIFE PASS offers and, where appropriate, supplies the contents, products and services to website visitors in its own name and on its own behalf.

Users should be aware that the contracting of the aforementioned services is governed by specific contractual conditions, according to the applicable legislation in each case, which are agreed by the users with the provider of the same and the travel agency.

TENERIFE PASS limits its liability to that attributed by applicable regulations in each case, in its capacity as a retail travel agency.

TENERIFE PASS is the owner of the database generated of the personal data provided by the user at the time of purchase, and therefore undertakes to comply with its obligation of secrecy of personal data and its duty to treat them confidentially. It will adopt the necessary measures to prevent its alteration, loss, processing or unauthorised access, taking into account at all times the state of technology in accordance with the provisions of current legislation in Spain on the protection of personal data.

TENERIFE PASS makes all necessary efforts within its means to offer the information contained on the http://tenerifepass.net website truthfully and without typographical errors. In the event that at any time an error of this type occurs, beyond the will of the travel agency at all times, it will be corrected immediately.

2. Means of purchase

TENERIFE PASS purchases can be made by the user through the internet and telephone sales. In the event of any unforeseen event that may arise in your purchase, you will be informed as follows:

  • If your purchase is for telephone sales you will be informed by phone, email or text message.
  • If your purchase is through the internet, you will be informed by email.

3. Payment Terms

The fact of requesting a purchase implies a commitment on the part of the customer to authorize the charge on the credit/debit card provided.

TENERIFE PASS, in purchases made through electronic/telephone sales, may require, after having made your purchase, the sending by fax or email, of the express authorisation of the paying customer and a legible photocopy of both sides of the card, DNI, NIE or passport of the holder. In the event of not receiving such documentation, the travel agency reserves the right not to confirm the purchase in order to protect itself from situations of doubtful viability.

4. Electronic invoicing

The user who makes a purchase through TENERIFE PASS, the telephone service department or the website, gives their express consent, in the event of a request, to send the invoice in electronic format to the email address provided by the user at the time of making the purchase.

According to data protection law, if you request modification of the invoice data or send to another e-mail, you will be required to authorize this change from the customer.

5. Contact

  • Monday to Friday: From 09:00 to 18:00 (Canary Islands time).
  • Saturdays and Sundays: From 09:00 to 14:00 (Canary Islands time).

SPECIFIC CONDITIONS

1. Hotels

1.1. Price

Sometimes, on our website there is a cheaper rate than another for a specific stay in a hotel. These rates created by hotels may entail restrictions and special conditions, for example, regarding cancellation and refund. It is important that you check the room and rate details carefully to know the conditions before making the purchase.

The price of the purchase of a hotel service does not include any unspecified service as well as extras such as drinks on half board and full board, minibar, telephone calls, parking, laundry services, etc. The user is solely responsible for paying any additional taxes that the authorities of certain countries apply (tourist tax, etc.) that must be paid at the destination, locally.

1.2. Voluntary modifications

If you wish to make any modifications, you can manage it by email or through the telephone helpline, see the “Contact” section.

In case of detecting any error on the same day of purchase, you must contact us within our business hours, so that the agency staff can verify the possibility of correcting said error. Remember that we will always inform you of the requested modification by the same means, so if you do not receive a response no later than half an hour before the closing time of our business hours, you must contact us again.

Changes: After the day of purchase, it will be the supplier who establishes whether or not it is appropriate and if it entails additional costs. TENERIFE PASS will charge for this procedure, the difference that exists with respect to what was contracted.

Cancellations: On the same day of purchase, it will be the supplier who establishes whether or not it is appropriate and if it entails additional costs. TENERIFE PASS will charge a booking fee of €12 per purchase. If you make a new purchase on the same day, these expenses may be refunded. For cancellations after the day of purchase, it will be the supplier who establishes whether or not it corresponds and if it entails additional expenses. TENERIFE PASS will charge a booking fee of €20 per purchase.

Exceptional cases of cancellation: In cases of cancellation due to hospitalization or death, it is subject to the criteria of the hotel establishment. TENERIFE PASS will charge a booking fee of €20 per purchase.

1.3. Special Requests

Special requests such as sea view rooms, double beds, cots, pets (dogs and/or cats), etc. are subject to the availability of the hotel establishment.

Hotel establishments have a limited stock of cots, so if you need this service you must indicate it by email info@tenerifepass.net or by phone at 609 073 804, always subject to availability. There are hotel establishments in which the right of entry of minors is reserved, so it is recommended to consult before making the purchase, see the “Contact” section.

Regarding cases in which you want to bring pets (dogs and/or cats), it is also important to check availability, conditions (weight and height) and possible supplements before making the purchase, as they are generally not allowed in certain establishments.

1.4. Check-in and check-out times

The usual check-in and check-out times are based on each hotel establishment, we advise you to know the particularities of the same in this matter, contact us, see the “Contact” section, to know the particularities of your purchase, in this regard. As a general rule, rooms can be used from 2:00 p.m. on the day of arrival and must be vacated before 12:00 p.m. on the day of departure.

Hotels reserve the right of admission to minors unaccompanied by an adult.

2. Transfers

The conditions of the transfer service are defined by the supplier, please read them carefully during the process of your purchase.

The price of the purchase of a transfer service does not include any unspecified service, in addition to extras such as: baby seats, additional luggage, sports equipment, etc., you must indicate it to us via email to info@tenerifepass.net so that we can request it from the supplier, the service being on request.

3. Car rental

The conditions of the car rental service and its rates are defined by each rental company.

3.1. Price

The price of the purchase of a car rental service will not include the cost of those extra services that have not been specified at the time of purchase, such as: baby seats, additional driver, GPS, etc. and the airport taxes of these services if applicable. These extras incur an additional cost and you can request it from us by email at info@tenerifepass.net where we will inform you of availability and its price.

Driving the rented vehicle outside the territory where it was hired may entail an extra cost. In addition, in some countries, crossing borders with the rental car may be prohibited.

Some car rental rates include restrictions, we recommend you read the terms and conditions carefully at the time of purchase.

Pick-up after the stipulated time and return at different offices may entail an additional cost, which will be indicated in the terms and conditions at the time of contracting the service.

3.2. Documentation

At the time of picking up the vehicle, you will be required to have a driving license and a valid DNI, NIE or passport along with a nominative credit card of the customer in the name of the person who appears on the purchase to guarantee the deposit and fuel, in case you do not have it, the local supplier may charge you a deposit by another means that will be returned at the end of the service (if there has been no No incident), depending on the supplier, he will agree with you how to solve the fuel filling.

IDENTIFICATION, RESIDENCE AND MINORS

All users, without exception (including children), must carry their corresponding personal and family documentation in order, be it passport or D.N.I., N.I.E.

Some TENERIFE PASS providers offer special rates for Canarian residents. It is the sole responsibility of the user to be able to prove their residence by means of a DNI or NIE at the time of carrying out the contracted activity. If such residence is not accredited, the providers reserve the right to cancel the activity without the user being entitled to any compensation for it.

Any minor must be accompanied by a person of legal age in order to enjoy the contracted activity(s).

CLAIMS MANAGEMENT

For any incident that may arise in the contracted services, you may send a letter to customer service by email info@tenerifepass.net or by filling out the following form, which will open a file and begin the appropriate procedures.

It is hereby stated that, by reason of territoriality, the competence in tourism matters corresponds to the Autonomous Community of the Canary Islands, as the company has its registered office there, having the administrative management and direction of its business centralised there.

Any official complaint addressed to our website must be requested at Calle El Roque, 22 in San Cristóbal de la Laguna, Santa Cruz de Tenerife, from Monday to Friday from 09:00 to 18:00 hours.

INTELLECTUAL AND INDUSTRIAL PROPERTY

All the contents and elements that the user may access through the services offered by TENERIFE PASS are subject to the industrial and intellectual property rights, patents, trademarks and copyright of TRALOPIA INTERNATIONAL SL or of third party owners of the same. Access to said content or elements through the services provided by TENERIFE PASS does not grant the user the right of alteration, modification, exploitation or reproduction, distribution, public communication or any other right that corresponds to the owner of the affected right.

The customer undertakes to use the contents and/or elements accessed through the services offered by TENERIFE PASS for their own use and needs, and not to carry out any direct or indirect commercial exploitation of them under any circumstances.

Likewise, TENERIFE PASS will not be liable for damages arising from infringements by any user that affect the rights of another user, or of third parties, including copyrights, trademarks, patents, confidential information and any other intellectual and industrial property rights.
